Does anyone have any info about filing in small claims court in the USVI (specifically STT)? I haven't been able to find much info.

You probably need to go down to the courthouse and talk to them. That is the way almost all govenment offices work.

Do you live here (sorry, too lazy to read your profile!) Have you checked with (I think this is the name) Legal Services of the VI? Let me know if you need to know where they are...

The main number for the Territorial Court of the VI on STT is (340)774-6680 and they can connect you to Small Claims.

If you live here, go to the Territorial Court Clerk's Office in the Alexander Farrelly Justice Center and they'll steer you towards the Small Claims filing clerk who'll give you the documentation you need. I believe the filing fee is still $40. You can either have a Marshall serve the papers or else use a private server - but they'll give you all that info.

Thank you all so much. I do not live on the island; however, visit there frequently. I will contact the clerk's office and hopefully they can get the document to me. Appreciate all of your help.

LOL! You expect them to mail or fax it to you???? I wouldn't bet on it in this lifetime. I'd Google secretarial services st thomas and see if one of them can get you the form (for a fee, of course). It's extremely difficult to do things like that without having a live person here to do it for you.

Oh well. I will probably just let it go. I was ripped off by someone there and have all of the documentation and thought small claims might be the way to go. Its only several hundred dollars and not worth the time and effort. Thanks anyhow.

Linda:

Do not give up that easily!

I work with the courthouse in St. Thomas on a weekly basis and have always found the staff to be informative and helpful. I live on St. John and cannot always walk into the courthouse myself.

Contrary to another posting,the courthouse has faxed forms and documents to me in the past.

Simply tell them what you need and they will help you to get this solved.

Dear Linda,

It's absolutely worth a try. Very often when someone is served with papers they realize that the intent to recover is serious and thus make haste to settle in order to avoid going to court. Too often too many "let it go" because they don't think it's worth the effort - which only gives the wrongdoer the go-ahead to scam someone else. Good luck!

If its a business... I think its worth contacting the business first to see if it can be settled or figured out, but since you said you were ripped off I figure you already tried that route. You can also try Consumer Affairs, http://www.dlca.gov.vi/aboutconsumeraffairs.htm.

It is a business...a personal chef that required a deposit and failed to show. I have called -- phone is disconnected. Website appears to be down, etc. etc. I will definitely try Consumer Affairs. Thank you so much.
